These Terms of Service ("Terms") govern your access to and use of bitebackdefense.com (the "Site") and any products you purchase from BITEBACK. By using the Site or buying our products, you agree to these Terms.

If you don’t agree, please don’t use the Site.

1. Who we are

BITEBACK ("we," "us," "our") operates the Site and sells tick repellent products direct to consumers. Contact: hello@bitebackdefense.com.

2. Eligibility

You must be at least 18 years old to make a purchase. By placing an order, you represent that you’re at least 18 and have the legal capacity to enter into a contract.

3. Products & claims

Our products are tick repellents formulated with plant-based active ingredients:

  • BITEBACK Human — uses Oil of Lemon Eucalyptus (Citriodiol/PMD) at 30%, listed on the CDC’s recommended tick-prevention list.
  • BITEBACK Pet — uses cedar oil, lemongrass oil, and geraniol; safe for both dogs and cats at intended use concentrations.

Both products are intended to qualify for the U.S. EPA’s 25(b) minimum-risk pesticide exemption. Repellents reduce but do not eliminate tick attachment. We make no representation that any repellent prevents 100% of tick bites or tick-borne illness. If you are bitten and develop symptoms of a tick-borne illness, contact a healthcare professional immediately.

4. Orders & payment

All prices are in U.S. dollars (USD). We accept Shop Pay, major credit cards, PayPal, Apple Pay, and Google Pay. Payment is captured at the time of order.

We reserve the right to refuse or cancel orders — for example, if a product is mis-priced due to error, if we suspect fraud, or if shipping to your location isn’t possible. If we cancel your order, we’ll refund the full purchase price.

5. Shipping

See our Shipping policy. Title and risk of loss for products pass to you upon delivery to the carrier; if a package is lost or damaged in transit, contact us for a replacement (Shipping Protection or our standard goodwill policy will apply).

7. Account & security

If you create a customer account, you’re responsible for keeping your password confidential and for all activity under your account. Notify us immediately of any unauthorised access.

8. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose
  • Reverse-engineer, scrape, or systematically extract data from the Site beyond what’s permitted by our robots.txt
  • Submit false or misleading information at checkout
  • Interfere with the Site’s security or operation
  • Resell our products without our written permission

9. Intellectual property

The Site, the BITEBACK name and logo, product designs, packaging, and all content (text, images, video) are the property of BITEBACK or its licensors and are protected by U.S. and international intellectual property law. You may not copy, modify, distribute, or create derivative works without our written permission.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal, non-commercial use.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Site and our products are provided “as is” and “as available.” We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that the Site will be uninterrupted, secure, or error-free. We don’t guarantee that any product will produce specific results in your specific situation — tick repellents reduce, not eliminate, tick attachment.

11. Limitation of liability

To the fullest extent permitted by law, BITEBACK and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim related to your purchase will not exceed the amount you paid for that purchase.

Some jurisdictions don’t allow these limitations — in those cases, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify and hold BITEBACK harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any third-party rights.

13. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising from or related to these Terms or your use of the Site will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in [Insert County / State of registered business address], unless otherwise prohibited by law. You waive your right to participate in a class action.

The exception: small-claims court for disputes within its monetary limits.

14. Changes

We may update these Terms at any time. The “Last updated” date reflects the most recent change. Continued use of the Site after a change means you accept the updated Terms.

15. Severability & entire agreement

If any provision of these Terms is found unenforceable, the rest will remain in full effect. These Terms (together with our Privacy Policy) constitute the entire agreement between you and BITEBACK regarding your use of the Site and any purchases.
